Legal Question in Family Law in Arizona

My daughter is 17 years old and we are interested in putting her deceased fathers name on her birth certificate. however we do not have any DNA to put him on her birth vertificate. I also would to change her last name to her fathers last name. Do have any idea how i would go about doing this?

You can file a Petition for Name Change for an Order that her name be changed to that of her biological Father so long as your motive is not fraudulent or to avoid creditors. Such Petitions are usually granted.

Obtain a Certified and Authenticated copy of the Death Certificate of her Deceased Father and attach it to the Petition or bring it to the hearing on your Petition that will be set by the Clerk of the Court.

You can establish who the biological Father is by your testimony that he is the only male that had sexual access to you during the gestation period you became pregnant with you Daughter. You lived together,dated etc. Pictures of you and him and/or the baby stage through Childhood.

Bring a good picture of the biological Father and show the Court the specific physical features that match him and your Daughter and you. Or unique physical family traits.

You can also bring any other evidence that proves he held himself out as the Child's Father,if any. For examples,post cards,letters,presents sent,money given etc.
