Legal Question in Family Law in Arizona

My daughter�s biological dad lives in Mexico and he has never been "in the picture". Now I have been married for 5 years and my daughter (9yrs old) wants him to adopt her. I do not believe that her biological dad will ever consent, what to do in these cases? Can a judge�s consent override his?

You may be able to terminate the biological father in order to allow your husband to adopt her. This is the only way to do it without the biological parent's consent.

The situation you are describing should warrant a "termination of parental rights", which then would allow for the adoption, even over Dad's objection.
