Legal Question in Family Law in Arizona
Deadbeat Dad
My exhusband was emplyed when we got divorced and was paying $500 month child support. He was laid-off and is currently self-employed. Recently he has stopped paying child support saying he can't afford to. He is 46 years old with an MBA but not actively looking for a job. What legal recourse do I have.

Re: Deadbeat Dad
You have the right to:
1. Do nothing. So long as he takes no steps, his obligation (at the $500 level) never goes away. (although you MUST take steps to enforce within 3 years of the youngest child's 18th birthday). If you do this, interest also accrues as to EVERY MISSED PAYMENT.
2. OR, you could seek enforcement, which can include a judgment, interest, and potentially incarceration. This would also likely prompt Father to seek a modification of support, which may or may not be granted.
We can absolutely help you in these decisions.
I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.
Please call me directly to discuss the specifics of your case, or contact my assistant Alicia to schedule a free 1/2 hour consultation.
