what is the differance between a volentary guardianship n a legal one

You may be thinking of a voluntary guardianship vs a Title 8 guardianship. The first requires Mom and Dad's consent (or at least lack of objection), whereas a Title 8 Guardianship can be imposed even over Mom and Dad's objection, but does involve CPS.
