Legal Question in Family Law in Arizona

Divorce

How do I avoid having to pay alimony to my husband (he makes 30k and I make 60K).

He has a job and can take care of himself. He committed adultery and owes me and my mom a lot of money. What is the judge likely to do?

Re: Divorce

This is not about making the judge not award him anything and because we are in a no fault state, his adultery has nothing to do with maintenance. There are many factors a court has to consider under the law, 25-319. I suggest you sit down with a lawyer and walk through those facts. It may give you some more details.

Re: Divorce

If you can show that your husband does not qualify for an award of spousal maintenance, he won't get it. ARS 25-319A contains the four-pronged test for spousal. If you pass A, the factors in B are then considered, and need is still a factor. If he can get by on 30K, which he likely can, then he shouldn't get anything.
