divorce decree

According to our divorce decree, my

ex wife and I agreed to me quick

deeding the home to her for a

specified cash out. She was

responsible for the first and second

mortgage. She refused to pay the

second mortgage because she said

she could not afford it, so I made the

payments to keep my credit in tact.

She verbally agreed to pay me back

once she sold the home. She has

sold the home and now refuses to

pay me. What recourse do I have. It

totals $9300.00 in payments that I

have made.

Depending on the language of your decree, you may have the ability to move to enforce your decree in family court or sue her in civil court for the money. I would have insisted in the decree that she be required to refinance the debt into her own name within a specified amount of time. This is a common mistake people make when the represent themselves. YOu could try and ask the court to force her to do so or sell the house to get the debt out of your name.
