Legal Question in Family Law in Arizona

Divorce is final

My divorce has been final for a year, I was not represented in court and I feel the court/judge was partial to my spouse and denied my request for a continuance in order to find an attorney. The divorce has become final and my spouse got everything and the judge based his decision on what she said - as I did not defend myself. Is there a way to go back to court and get the contents of the divorce overturned including the child custody and the support?

Custody and support can generally always be modified. The remainder of your decree will likely be very difficult to modify. However, I would need to know more details to give you a full assessment.

We can absolutely help.

I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.

You can bring a motion to modify child custody and support at any time, based upon changed circumstances. It is probably too late to change other aspects of the judgment, unless the judgment was obtained by fraud. The time to file a motion for reconsideration, or an appeal has long expired. To prove fraud, you would have to show that your husband materially lied on his property declaration or income and expense declaration.
