Divorce

If my husband was still legally married to his first wife when our wedding ceremony took place, are we legally married? Subsequent to this... Do I need to obtain an actual divorce from him since our marriage has failed.

No, you are no legally married. Polygamy is not legal anywhere in the United States anymore, not even Utah. The first marriage is the only thing that is still valid, unless it was legitimately dissolved at some point.
