divorce / selling
My wife and I are divorcing after 10 years. We are very much in agreement of dividing all assests and child support.
We have not filed because our house, that we both still live in, is for sale. When it sells we will go our seperate ways.
We were told that ''if we file for divorce before the house sells, the court has to approve the sale and that could scare off a potential buyer, so sell then file''.
Is this true or can we file while our house is on the market?
We both have agreed on the lowest price we can go, and we both agree on splitting the profits 50/50.

That statement is NOT true. So long as you both AGREE to all terms, the Court does not need to know it is being sold, and your buyer does not need to know you're going through a divorce.
Please know we can still help even in a totally uncontested dissolution. We charge an $800.00 flat fee for an uncontested matter, which covers all paperwork and all needs start to finish. The only other expense would be the $276 filing fee which gets paid to the Court.
