Legal Question in Family Law in Arizona

I am divorced and have sole custody of our 4 children. My divorce papers state that should either parent move 10 miles away from their current residence, that they will need to notify the other parent and get written permission that they are ok w/ the move, or get a court order stating that moving is in the best interests of the children. I have not been in contact w/ their father for over a year. The last time I heard he was living in a halfway house in Mesa. I will be moving over 100 miles away in July due to my upcoming marriage, and I am wondering what I need to do to get a court order? Thank you!

This is a farily tricky issue. 25-408 governs over relocation but you have added issues as a result of losing contact. I would have to read over your paperwork to provide a safer answer. Feel free to call my office and make an appointment if you are in Maricopa County.
