Legal Question in Family Law in Arizona
I have been divorced for 6 years, my ex husband did not keep a job to avoid child and alimony. He is now in a stable job for 2 years. He is a felon now and on probation for the next 3 years, I believe, I was trying to help him as I tried to remain friends for our kids sake and recently found out he is getting married. I am wondering now that he is doing better then he was saying financially could I get my alimony? And lawyer fees? he was to pay that I did pay to prevent issues for myself. I am now unemployed. I am also wondering if I can prevent him from allowing his fianc around my kids ever she to is a felon on probation. Is there a statue of limitation? I have sole and separate custody of our children?
1 Answer from Attorneys
You certainly have the right to seek child support, but spousal was likely forever waived. I would need to see your Decree. If you were granted attorney's fees in the Decree, those can still be enforced. But you need to act quickly.
You can seek orders restricting his fiance's access to the children if you can convince the Court that she poses a threat.
We can certainly help you consider and then pursue your options for enforcement and modification.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation.
