Legal Question in Family Law in Arizona
How dose one go about fixing a court order with out going back to court?
Here is the problem:
IT IS ORDERED that Father shall have parenting time with the minor children on
alternating weeks from Thursday at 6:45 p.m. until Sunday at 5:00 p.m.
Mother changed school districts and now the children (2) twins. One goes to "school" monday, tuesday, thursday and friday (for behavorial problems). While the other has 1 (one) Therapy session on friday at noon.
Had tried to ask how she was going to make up days and her (mother's) idea was to give it back through holidays. Needless to say her idea was to give back days that father already had through holiday schedual. There are 3 major holiday times and the mother is willing to give up part of "spring break" and something about 1 extra week in the summer which is only 14 days. Is asking for the days to be done in the summer unreasonable? And how do I keep this out of court if the mother doesn't agree? She's good at taking days away from the father.

You can seek an agreement with her. If she will not agree, and you still want the change, unfortunately you will need to involve the COurt. The simplest method is to seek mediation through the Court, which mom would be required to attend. Otherwise, you would need to seek a modification.
We can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.
We have three attorneys. We charge from $220 per hour to $250 per hour. Our retainers can run as low as $500 for demand letters/phone calls, $1200 plus costs for uncontested matters, or from $2,000 to $4,000 for most contested matters. We can also structure assistance to help you represent yourself if your prefer, whether by the project or by the hour.
Please remember that a retainer is just a prepayment of time, and is not an estimate as to the total costs of the matter. If I finish within the retainer, then I refund any unearned amounts.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
