Legal Question in Family Law in Arizona

Drinking around kids

do judges look down on a step parent if she drinks occasionally (1 or 2 drinks a month) around a child? Can it keep the birth father from getting more visitation with child. birth mother does not drink and feels like step mother should be ordered to stop drinking.

Re: Drinking around kids

Generally speaking, a court won't forbid an adult from consuming alcohol, since that is a legal activity; however, if there is a concern that relates to children, a judge can order parties not to consume alcohol in the presence of the children. In the situation you described above, if the step parent only consumes 1-2 drinks per month, perhaps it would be easiest for all parties involved to agree that those drinks will only be consumed at times that the children are not present. If the stepparent is not able or willing to agree to avoid drinking alcohol in the presence of the children, then there may be a larger issue to deal with.
