Emergency custody

My husband and I have been fighting to gain full custody of his son because his ex moved out of state and left him in our care and in about 5 months has had limited contact with us or him. Since finding out that we are filling for full custody she has instructed her parents to deny us access to our son when it is not ''our days''. Are the grandparents, who have no legal rights to him, allowed to hold him from us with her being out of state? Would this situation allow for us to file for emergency custody? And if so How long does it usually take to have emergency custody granted?

Some judges wouldn't consider this an emergency at all. HOwever, it seems to me you need to get a petition to modify going so you can formalize this situation into a document. Please let me know if you need assistance.
