You will need to file a petition to modify the child support so that it is based on one child, not two. You should file in May 2008 if graduation for the oldest is in May or June. You will have to do the same the following year, but with a petition to stop child support. Child support does not continue for college unless the decree provides for it.

He cannot "terminate" support until the oldest child graduates. He should file a Petition to do so approximately 2 months early. He may be entitled to a modification of child support when the next child emancipates, as he should only owe for one child thereafter. We can help you run some calculations to determine if a reduction in child support is warranted. She CANNOT extend child support for college purposes.
