Legal Question in Family Law in Arizona

Enforcing a Court Order

Ex Spouse was ordered to pay $500 on the 3rd of this month and $500 on the 18th to assist with a vehicle for me. He was also ordered to pay back (and current) child support since June 1, 2008. Since I had to use the $500 on the 3rd to make the first vehicle payment, he purposely wrote out a check on that date for ''child support'' and not the vehicle. He said that his attorney advised him that this would be the best way to go so that he can catch up on child support. He is still behind. With respect to the two payments of $500 which havent been paid, what recourse do I have? File a Motion to Enforce? I'm on my own; no attorney.

Re: Enforcing a Court Order

Yes you need to file a motion to enforce the terms of the decree. Spell out in your motion what was ordered and how he has failed to comply. Include all aspects of the decree that he has failed to comply with to make sure they are all addressed at once and that you dont waive any of the reimbursements.
