Legal Question in Family Law in Arizona
Because my ex-husband says he can't afford to reimburse me for medical bills for our daughters, he was ordered to provide me a copy of his tax returns. (he is not allowed to claim our children because he is in arrears). He has always claimed the girls and he makes excuses as to why he cannot provide the copies. After three times failing to provide them to me, the judge finally ordered him and he did provide them. I believe the copies he provided me are not the copies he filed with the IRS. Reasons: 1) I tried to e-file last year and my daughters ssn had already been claimed, and 2) I went to the "where's my refund" and entered in the info HE gave me, and it couldn't locate his return. He knows he is not allowed to claim the children, yet he does. If they judge finds out that he did, he would be in trouble, and he knows this. This is why I believe he provided me with �fake� copies. How can I prove this? His sister is an accountant and I can only assume she may have helped. Can I make him file a 4506-T and get the copies straight from the IRS? Can I request copies of his bank statements showing the direct deposit from the IRS with the refund amount?

You may be able to ask the Judge to ORDER HIM TO SIGN a power of attorney allowing you to access the records yourself. And yes, you can subpoena his bank records. And yes, I expect the Judge will not be pleased if he claimed them despite multiple orders not to.
