Legal Question in Family Law in Arizona

ex-husband wont sign

My ex-husband and I were divorced about 6 years ago, at the time we had a long drawn out divorce and I had met and was living with someone. I got pregnant by my husband now and his attorney used that pregnancy as a way to try and get his way. Stating that since i wasnt legally divorced that my ex-husband had legal entitlements to my unborn child. It has been four years and my ex-husband still wont sign the acknowledment of paternity knowing the child is not his, we need to get my husband now on my sons birth certificate..what can we do?

Re: ex-husband wont sign

This is somewhat confusing. If your ex-husband is on the birth certificate and his attorney asserts or alleged rights to the child, is your ex-husband paying child support? Children born during a marriage are presumptively the husband's, however that can be rebutted. You could have your husband file an Affidavit of Paternity.
