Legal Question in Family Law in Arizona
I have a family situation I am seeking legal advice on.
Current Situation: Last month my husband of 14 years left his family (myself, and two young children: ages 3 and 8) to work in Chicago. He stated he would continue to deposit the monies needed for bills. This has not been the case. One week after he left I was served with a Civil Summons on a debt I knew nothing of. He had taken several cash/payday loans that he states are over $7000. The bills are not being sent to our home address. Our home of 6 years is in foreclosure status that he is working on a loan modification for.
Background: My husband is a gambling addict, and has been most of our marriage. He claims to be in remission for 3 years. He takes prescribed medicine for ADD, for which I believe to be a misdiagnosis. Our life has been filled with his poor choices, insurmountable debt, bankruptcy, addiction, pornography...it never ends.
For the last 9 years I have worked part time or stayed home to care for my children. I had a part time job before he left but needed to resign as I could not afford the childcare being a single parent.
Conclusion: I am fearful of wage garnishments/law suits if I try to bring in income. Is there a way to protect myself, and my children? Is a legal separation or divorce needed? Am I responsible for his debts in the marriage although they are the result of deception, addiction, and poor mental health?
