Hello, My fathers wife divorced him unexpectally, and left him deserted, he's 77yrs old for 32 days he had to depend on neighbors to feed him, well he was served a summons and had to respond in a certain amount of days, he cannot see very well, he filled it out the best way he could and sent it off just to have it return with insuffient address, I came from CA to pick him up and take him out state to my home, well right now there is a default hearing scheduled for 3/26/03 in ariZona, we need to contest the alimony issue, I reliZe that they have been married for 10.5yrs and may be eligible for my father's social security, is there any way I can delay a motion for signing a decree? my father only gets 954.00 a month from s/s, he did't understand the procedures involved to fight this, I've left a message to the judge involved, but they cannot return long distant calls so I said, I'll be there for the default hearing, If I send the response and the filing fee's could I fight this??? help. thank you -

Based upon the facts as you've described them, I would expect that the Court would not let the default hearing go through SO LONG AS YOU FILE APPROPRIATE PLEADINGS IMMEDIATELY.

Unless you are an attorney you cannot represent your father. The judge might not even let you speak. Contact a local attorney to -- at a minimum -- file a proper response/answer and/or ask the court for a continuance (postponement).
