Legal Question in Family Law in Arizona
Father's spouse is mexican national, married in mexico, she abandoned him 10 yea
Father (80 years old) married mexican national in mexico about 20 years ago. 10 years later, she abandoned him, took everything in the house, but never filed for divorce. Father's property (house and land) belonged to him free and clear before they got married. We assume she is waiting for him to die so she can get the his property as his widow. Other than divorce, which he can not afford on his limited income, how do we get her name off of the title to the house and land?

Why would her name be on the title if he owned it free and clear before they married?
If he added her name after marriage, then he "gifted" her an interest, which can only be taken away through a Divorce (unless she is willing to agree to sign a "Quitclaim Deed").
If her name never was added to the Deed, then your Father should STILL file for Divorce, and make it clear that she has no interest. He could also draft a simple will.
Please know: divorces can be almost free if he will do the paperwork himself, and seeks a waiver of court costs.
