how do I file abandment papers

my wife walked out on our two kids and myself the home is in only her name she bought it in her name only we were married at the time and are still married I can't even talk to the morgage company it is in her name too.but they will let me pay the bills

It seems like divorce is your first cause to file with the courts. In filing, you should probably ask for sole custody of the kids and child support. Even if you can't collect it, it will show the court in the later abandonment (severance) action that she has truly abandoned the kids. As far as the house goes, have it awarded to you completely in the divorce. The debt will be in her name and you would be able to sell without her since you would be the owner. If you want to refinance, you could do that, too.
