I filed the papers and served her...how long until she has to accept the service

I filed for divorce last Tuesday. I served her personally on Thursday. She has yet to sign the accceptance paperwork. How long does she have to sign the acceptance? Should I just serve her using the Sheriff? Thanks.

Thank you for your inquiry.

Your wife is not "required" to sign the acceptance of service; she may do so if she chooses. Since it needs to be signed in front of a notary, that might be inconvenient, and she might be waiting for a good time. Also, some people think that if they sign the Acceptance, they are automatically agreeing to everything in the petition, but that is not true; the Acceptance only acknowledges receipt, not agreement.

If you are on speaking terms with her, you can call to find out if she plans to sign, and convey the same information that I explained above. Otherwise, you can give her a few days, then arrange for a process server. You will probably be better off with a private process server (out of the phone book) than a sheriff, because the sheriff's office tends to be more expensive and they take longer.
