Legal Question in Family Law in Arizona

Filing default

We filed default the 20th day like we read on the packet. We got a written response saying the Pro bono lawyer and my husbands ex disagree with the petition. They didn't file it with the courts, but they got it stamped and dated. On the papers they sent it says she can not pay filing fees and that we have to pay them. Are we still in default or where do we go from here?

Re: Filing default

First, the Application for Default needs to have been filed on the 21 st day, not the 20th day.

Second, once you file the Application for default, the Respondent then has 10 more days to file a Response.

SO, I expect the response probably was filed timely.

We can absolutely help you determine where you are and where you need to go.

I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.
