grandparent rights

my son and his girlfriend had a baby in aug. 2000, we the grandparents, had visitation w/our grandson, up untill 2 months ago. my son moved out of his girlfriends house, and we could not visit anymore,i served her with papers for my rights for visitation, and on her response said that the baby was not my sons child! and that i had no rights! that the baby was her husbands child!! which has passed on. the baby has my sons name on the birth certificate as jr.what rights do i have now?can i file temp.visitation? i have not seen him in 2 months the mother lied on those papers!! the baby looks identical to my son!!!

You son has the ability to "establish" paternity in virtually one day, since his name is on the Birth Certificate.

Clearly, you must establish legal paternity before your rights can be established under the statute.
