Legal Question in Family Law in Arizona

Guardianship

I left my son in the care of the woman who raised me. I want my son now and am stable and can take care of him. she says no but never filed the guardianship papers. Can I just go get my son? What are my rights and what do i need to bring in order to get him?

Re: Guardianship

If there have been no papers filed, you should be able to go get your son. You need to take some evidence that you are his parent, perhaps a copy of his birth certificate and/or his social security card. You will also need to take some ID for yourself. Check with the law enforcement agency where your son is presently living to see what they want you to have.

If it has been a long time since you left your son there, realize that this person may have some right and/or ability to raise a claim that you abandoned your son, and seek a legal right to your son based upon that.
