Legal Question in Family Law in Arizona
My husband wants to adopt my son, my son's father doesn't have much to do with his life he doesn't see him, he doesn't pay child support (he's currently about 5,000 behind), and rarely if ever calls to talk to him. My son is 3 years old and only knows my husband as his dad. Do I stand a chance in having my husband adopt my son if his father decides to fight it? Can his father keeps rights even id he does nothing for the child. I also have sole custody if that matters to any of this.
1 Answer from Attorneys
From your description, you have an excellent chance at terminating the Father's parental rights even over his objection. Once the termination is granted, the child then can be adopted by your Husband.
We can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail. Please ask for attorney Carlie Owsley Walker, who handles most of pr termination/adoption proceedings.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
