Legal Question in Family Law in Arizona

My husband left in November. We have not yet decided where we stand. In the meantime I filed for child support for help to care for our 3 children. Right now I am the sole provider and caretaker. I was denied child support because we are married, is this correct?

While our statutes DO state that he is responsible for the support of his children, we also have a statute that states that no child support order is valid while the parties are married. So YES, it has been my experience that I need to file either a Petition for Legal Separation or a Petition for Dissolution in order to be able to obtain child support.
