Legal Question in Family Law in Arizona

My husband is ordered to pay child support and does so every two weeks. His employer takes it out of his check before he receives it. About 3 years ago we paid off the arrearages that accrued the first couple of years of the childs life before support was established. Every two weeks for the past 6 years child support has been taken out reflecting this on his pay stubbs. We received notice from the child support office that they have not received any payments for the past 3 months. We faxed them copies of his pay stubbs reflecting that the payments have been taken out. They were going to send his employer a notice of non compliance. Can my husband get into trouble for this. As far as we knew the support payments were being made because they were taken out of his check. I appreciate any answers you may be able to provide.

It sounds like a Clearinghouse issue. I would not beleive your Husband would have any resposnibility. HOWEVER, he certainly does want to make sure he takes all necessary steps to correct the Clearinghouse records.

We can certainly help you consider and then pursue your options if you want legal assistance in correcting these records.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
