You are right to be concerned, because Arizona law DOES give him the right to pursue these overpayments back from you. However, he must file that request within twenty-four months after the termination of the obligation. How much time has passed?

In any event, one option is to just mail him back the money each month. OR, put it in a savings account in case he does file something in a timely manner. OR, if you really want to take care of it yourself, we couled file a Motion to Terminate his Wage Assignment.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Paige or my paralegal Jennifer to schedule your free 1/2 hour consultation.
