Legal Question in Family Law in Arizona
My husband and I r getting a divorce and we have a 3 yr old daughter my question is my huband and i moved here in 04 from minnesota and now i want to take our daughter back to mn to live because theres no family or anything else here for me. He has some family here and wants to stay. Is there a way they can make it work that both of us would get to see our daughter and live in different states?

There are many different ways that a long-distance parenting arrangement can work, depending on your child's needs and whether there are sufficient resources available to permit frequent visits (initially by the parent(s), but later by the child, once she is old enough to travel).
Relocation is generally difficult to accomplish unless both parents agree to the arrangements. In the absence of an agreement, the court would have to decide whether it is in your daughter's best interests to remain in Arizona or to relocate to Minnesota.
The considerations can be more easily explained in person, so please contact our office to schedule a free initial consultation (480.792.9770).
Long distance parenting plans can be difficult, but of course can work. When she becomes school age, the school schedule will likely dictate the plan.
We can certainly help you consider and then pursue your options.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
