Legal Question in Family Law in Arizona

My husband and I are seperating and heading to divorce. I have an offer from a family member for me and my kids to come live with her in another state. Can I legaly take my kids out of state? Is there anyway that my husband could claim kidnapping or something like that?

This is a VERY tricky issue and must be well considered before steps are taken. My best advise is that you should sit down with an attorney experienced in family law in order to discuss the pros and cons of any step.

ONCE A PETITION IS FILED, the children CANNOT leave the state with a written agreement or Court order.
