Legal Question in Family Law in Arizona

How do Iget an emergency change of custody?

My boyfriend took his ex-girlfriend to court so that he could pay child support for his three children. His children live with their mom and her boyfriend in arizona. Neither of have steady jobs and at this time are not working. They expect my boy friend to support them and his kids too. For the past two months they have had no place to live and have living off of friends andfamily members. My boyfriend and I both have steady jobs and are planning getting married soon. We feel that we can provide a better and more stable home life for his kids. How do we get an emergency change of custody?

Re: How do Iget an emergency change of custody?

An emergency change of custody can be sought by filing an appropriate Petition to Modify, along with a Petition for Order to Show Cause re: Emergency Temporary Orders, with supporting affidavits. You must be able to convince the Judge therein that the children are in immediate jeopardy.

I can explain the procedures better by phone or in person. There is too much to cover via e'mail (and I am not the greatest typist). We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Cathy to schedule a free 1/2 hour consultation. I look forward to talking with you.
