Legal Question in Family Law in Arizona

ileagal seasures of goverment income tax by Az. division of child support.

My ex wife violated mich. court orders by removeing our doughter from mich.with out notifing mich. f.o.c.or myself in 91 or 92. last jan. I recieved notice from Az f.o.c. of a 24000.00 arrears owd in Az. In 94 I leagaly was relieved of any obligation to pay support due to my ex left no forwarding address where we could find her.Now Az filed with the irs notice of my alledged back support and the irs has already siezed 600.00 and threatened me of more of the same can they do this ?I have sent coart orders, and they wont even return calls, and all i get is spun around with no ansers. Is there hope out there for me?

Hello, I have received a copy of your post regarding an Arizona arrearage. There may be options open to you. Much will depend on whether you ever received notice that your child was in Arizona or that there was an Arizona support order. You may need to consult with both an Arizona attorney and a Michigan attorney. I would start with the state you live in. The answer to your question really depends on how exactly Arizona began considering you to owe child support. If they did so properly, than the Judgment likely will stand. If they did so improperly, the judgment should be able to be vacated.

The basic thing is to see what order was entered first....Arizona or Michigan. Then, start with that state and attempt to straighten out the problem. It will take a lawyer and appearances in court. While you may feel that this is very unfair because your ex-wife caused all these problems, you may be able to do something on a parental kidnapping charge (if that statute was in effectat the time). You will have to spend some money but it will be worth it because the alternative is not good.
