Legal Question in Family Law in Arizona

The Joint Custody agreement states: "Neither parent will move with the child(ren) out of the Phoenix metropolitan area without prior written consent of the other parent, or a court ordered Parenting Plan..." Does that apply to both parents regardless of the child's residency, or does that only apply to the parent that holds primary residency?

Generally, this situation applies to the children's residence - in other words, the parent with whom the child resides is not to move outside the specified geographic location. This does not limit the non-residental parent from moving; however, relocation by the non-residential parent may affect the parenting time schedule.
