Legal Question in Family Law in Arizona

Joint Custody Father Rights

Is it possible to gain joint custody of my 2 yr old daughter if I was never married to her mother? I've heard that AZ is a mother's rights state and that it's unlikely to gain joint custody if un-married. I have been in her life since birth but did not officially file for support/custody/etc. until recently.

Re: Joint Custody Father Rights

Custody and visitation are based on the best interests of the child. The statute is specifically gender-blind, and there are a list of factors that the court considers.

Re: Joint Custody Father Rights

I disagree that Arizona is pro-Mother. I know a large number of cases where a Father has Joint Physical Custody or Joint Legal Custody.

Instead, I think the answer depends upon all relevant factors. So I would need to know more to give you a better idea.

I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.
