Legal Question in Family Law in Arizona

joint custody one parent attempting to move with child

Recently joint custody was granted with visitation. The parent with physical custody has sent a certified mailing with a letter stating that they are moving to Wickenburg which is approximately 200 miles from current residence. They are not providing and address or phone number for contact only an address for a pick up from a gas station. The paper sent to me is not a court document and the court visitation is still in effect. The other parent is expecting me to drive this distance to retrieve and return our child. The other parent is attempting to change the visitation as well as move to make it very difficult to see the child. I need help! Please tell me what paper work do I need to file with the court to dispute this action. I would greatly appreciate any assistance.

Re: joint custody one parent attempting to move with child

Thank you for your inquiry.

If you disagree with the relocation, then you need to file a Petition to Prevent Relocation. This petition must be filed within 30 days of the date you received her notice by certified mail. The court will schedule a hearing to discuss whether or not the child will be permitted to relocate, and the appropriate adjustments to visitation and transportation arrangements.
