Leaving town w/ a child
I am contemplating divorce w/ my husband b/c of drug addiction and affair; I would like to move out of state if I leave to be w/ my family for support. We have a 20mth old-could I get in trouble if I leave w/ him before seperation or divorce is final?

This is a decision that MUST be made carefully, because the Court can question the decision whether made before filing or after.

You won't get in trouble if you leave before the case is filed. If it gets filed and served, you will need a court order to allow you to move out of state while the case is pending. However, if you move prior to the case being filed, he can file here because jurisdiction is likely to still be here. YOu might check the state where you plan to move to see if you can get emergency jurisdiction regarding the child but doubtful.You may want to secure counsel here first and get the process moving as soon as you leave.
