Legal Question in Family Law in Arizona

I am not legally separatated from my husband but I am currently living in a different state and having to financially support myself. Can he place any claims to my income or property purchased after the physical separation?

YES.

Under Arizona law, every penny you earn, every asset you acquire, while still married, is "community", and subject to "equitable division". Further, every debt he acquires is technically "community" also. The only way to "draw the line" is to file for either divorce or legal separation.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
