i live in arizona and my husband is in indiana he keeps telling me we are not seperated are we

Your comments show that you are physically separated. "Legal Separation" is different. Some couples choose not to get divorced for personal or religious reasons. Under Arizona law, the procedures to obtain a Legal Separation are similar to a divorce and can take the same amount of time; however at the end of dividing up assets, debts, property, and any issue with children, the parties are still a married couple. You don't have to get a legal separation, but there might be some advantages, especially in separating yourself from new debts or financial obligations of the other party. An attorney will have questions about these details, especially whether Arizona or Indiana is the more appropriate court.

You didn't mention whether there are children of the marriage under the age of 18. If there are children, a whole additional layer of issues come into play.
