Legal Question in Family Law in Arizona
I live in Arizona and have legal and sole custody of my son. My exhusband lives in Florida and did not send my son back when he was suppose to. He then rang up thousands of dollars in medical bills. In our divorce decree I pay 66% and he pays 34%, however, he has not paid a dime and now wants me to pay. However, I did sent the emergency court documents to all creditors, which stated he was in contempt of court, and all creditors removed my name from future billing, other than the original charges to my insurance. I also cancelled the insurance during this time, as these were unauthorized charges. Do I have any legal responsbility to pay my percentage? Also, in Arizona, the law states the parent has 180 days from the time of medical service to request the other parent for payment, which he did not due.

I am sorry to learn that your ex has not been cooperative in parenting your son. In order to help, I would need to review your divorce decree because it may govern when payment is due and it probably covers who is responsible for payment of insurance. where your son is now... was he returned? What medical condition was treated... was it emergency medical care? Why was the insurance canceled? We probably should map out a strategy with you to resolve the issue. If medical care was rendered to your son which is reasonable and necessary, the medical provider is entitled to payment or it will sue one or both parents. You have sole custody; therefore, you may have an obligation solely to pay the bill, subject to reimbursement from your ex.
