Legal Question in Family Law in Arizona

I live in AZ. My Father died in January and my Mother is alone in California. My husband had and affair and we are divorcing and selling our house in AZ. We were planning on moving to California to be closer to my Mother but go our separate ways in the same city for our 7 year old son. Now my Husband is changing his mind and wants to stay in AZ and says he will not allow me to bring my son to California now to be closer to my Mother. His reason to change his mind is no other reason but for spite due to the fighting we have done over the affair. What do I need to do to still move to California with my son?

Once the divorce has been filed, you cannot move while the case is pending. You could leave before the divorce is filed, but there can be serious negative reppercussions in doing so. You could file for divorce and then ask the Court for permission.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation
