Legal Question in Family Law in Arizona

I live in Az., where I filed for divorce after my husband left us and moved out of state to Pa. I have one child with him. I filed for sole custody and he wants to fight for joint custody...is this possible, with us being in totally different states?

It is possible to have joint custody from two different states if the parents are able to effectively co-parent despite the difference. "Joint custody" does NOT mean "equal parenting time," it means that you both make decisions together regarding your child. It is usually not feasible to share equal time from two states, especially with school-aged children, but even if your child resides primarily with you and visits with your husband on occasion, that would not prevent you from having joint legal custody.

I agree with Ms. Donaldson and I usually give the client examples that you could live in Egypt and he could live here and share joint custody. Making decisions with the other parent becomes a lot easier with the advanced of modern technology like email and fax and texting. Depending on your relationship with father, you might try and negotiate allowing for you to have ultimate decision making authority but only after reasonable consultation with father. "Joint Legal Custody" pertains to equal rights to make major decisions. Some Judges would believe this is possible with today's technology, some would not. Joint PHYSICAL Cstody is certainly not realistic.
