There really is no rule dictating that. In a custody action, the court can look at the wishes of the child no matter the age. However, 1, the younger the child the harder it is to give it much weight and 2. it's only 1 of many factors the court has to consider.

Arizona law requires that the Court MUST consider the desires of the child, but it is only one factor of many. SO, there is no age where a child just gets to decide.

We can certainly help you consider and then pursue your options in your custody matter.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
