Legal Question in Family Law in Arizona

Is my marriage legal?

My wife and I got married last year right after her and her ex had come to an agreement on their divorce. We left town thinking he was signing the agreement and it would all be over. We went to Vegas for vacation and ended up getting married. When we returned he had decided not to do the agreement, and they ended up a few months later with a divorce. Her name has been changed with both social security and the Motor Vehicle Department but her mother is worried if it is legal. Since we received a legal certificate from Nevada and even social security has accepted it isn't it legal? If not, how can we make it legal, her name is already changed everywhere.

Re: Is my marriage legal?

If she was not single by formal Decree of Dissolution, then your Vegas wedding has no real legal significance. You need to obtain a new wedding license and go through a new legal ceremony, which can be handled quickly through a local Justice Court.

Re: Is my marriage legal?

If you "married" before her divorce decree was signed by the judge, then your marriage is not valid. Assuming that her divorce is now final (meaning that the judge has signed the paperwork), you now need to obtain another marriage license and have another marriage ceremony in order to be validly married.

I hope this information is helpful.
