Legal Question in Family Law in Arizona

I am not married to the father of my newborn baby and we both reside in Arizona. No custody or child support paperwork has been filed, but he is on the birth certificate. Can I move to Illinois or do I need his permission?

historically notice was provided but now, under new laws, the statute does not require notice to him or court permission. Just be prepared for him to file something here asking the court to order the child reside in Arizona. You will likely have to battle it here from Illinois. There are no legal requirements for notice at this time. However, whether or not to give him notice should be a matter of great consideration, because there can be repercussions for leaving without notice, and there may be repercussions in providing advance notice.
