Legal Question in Family Law in Arizona

If my ex who I was not married to plans to sign over his parental rights after the birth of my daughter, can I still file for child support from him? And will I have to put his name on the birth certificate in order to do so?

If he consents to the termination of his parental rights, that alone DOES NOT terminate his obligation to pay child support. That obligation is only terminated once the child is adopted (if ever).

We can prepare a very strongly worded waiver of his rights on your behalf, and can also assist in the pursuit of child support. I WOULD NOT RECOMMEND starting that process until after he waives his parental rights.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
