Legal Question in Family Law in Arizona
I am married as of right now. My wife left me and our 3 1/2 son about 5 weeks ago. Yesterday i got a call from a Marshall and said since we were not married when our son was born my wife has legal temp custody. Is that true. He has been our custody since he was born. This is not the fist time she has left us. I am filing for a divorse but in the meantime does she control who gets our son. I lives with me in our house and he has his own bedroom. What are my rights?
1 Answer from Attorneys
That is not true. Until a Court issues some sort of Order, neither parent's rights exceed the others/ You could and should seek temporary orders asap so that she cannot deny you your relationship with your child.
MY FIRM handles NOTHING but family law matters. We can certainly help you consider and then pursue your options for separation or divorce along with expedited temporary custody orders.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gina or my paralegal Jennifer to schedule your free 1/2 hour consultation.
