Legal Question in Family Law in Arizona

What happens to mortgage when divorced

I was divorced about 6 months ago and my ex husband got the house. The mortgage is still in both of our names. He wil not refiance. Is there any way I can be removed from the mortgage so that it will be taken off my credit report and I won't be liable for the mortgage?

Re: What happens to mortgage when divorced

The answer to your inquiry depends on the language in your divorce documents. If he is not keeping current in the mortgage payments, you may have a remedy even if it isn't clear from the documents. If he is current, the existence of that mortgage on your credit report should not be detrimental (though you'll have to show your paperwork to the lender if you plan to get another mortgage).

Please feel free to contact my office if you would like to discuss this matter further. I offer an initial consultation for $30 for 30 minutes, or $60 for 60 minutes.

Sincerely,

Monica H. Donaldson
