Legal Question in Family Law in Arizona

The mother of my children and myself are no longer together. She has had CPS called on her twice in the past. She is neglectful of the children (all three have been to the ER in the past year, the baby has actually been twice) and has no means to support them, ie no job, no education. She is currently about to be evicted from her home. She has threatened to take the children out of state. Would this be grounds for filing for emergency custody? I am employed and have the girls on my insurance, and have a stable home for them to live in.
